Introduction

These Terms and Conditions govern the provision of services by Harbour Haven, a senior care residence located in Burlington, Ontario. By engaging our services or using our website, you agree to be bound by these terms. Please read them carefully before proceeding with residence admission or use of our facilities.

Definitions

  • "Residence" refers to Harbour Haven and its facilities at 4280 Lakeshore Road, Burlington, Ontario
  • "Resident" means an individual receiving care services at the Residence
  • "Family Member" or "Representative" refers to designated contacts authorized to make decisions on behalf of the Resident
  • "Services" includes assisted living, memory care, respite care, and related support provided by the Residence
  • "Agreement" means the residence contract signed upon admission

Admission Requirements

Admission to Harbour Haven requires:

  • Completion of a care assessment to determine appropriate service level
  • Provision of medical history and current health information
  • Designation of an emergency contact and, if applicable, power of attorney
  • Agreement to the financial terms outlined in the residence contract
  • Availability of an appropriate suite matching assessed needs

We reserve the right to decline admission if we determine we cannot adequately meet an individual's care needs or if admission would compromise the safety or wellbeing of existing residents or staff.

Services Provided

The Residence provides services as outlined in the individual care plan and residence agreement. Standard services typically include:

  • Accommodation in a private or semi-private suite
  • Three meals daily plus snacks
  • Personal care assistance as assessed
  • Housekeeping and laundry services
  • Activities programming and wellness initiatives
  • Coordination with healthcare providers

Additional services may be arranged separately and will incur additional charges. We do not provide acute medical care or long-term nursing care beyond the scope of assisted living services.

Resident Responsibilities

Residents and their representatives agree to:

  • Provide accurate and complete health information
  • Report changes in health status or care needs promptly
  • Treat staff and other residents with respect
  • Follow Residence policies regarding safety and community living
  • Maintain financial obligations according to agreed terms
  • Inform staff of planned absences from the Residence

Financial Terms

Fees and Payment

Monthly fees are stated in the residence agreement and are payable in advance. Payment is due on the first day of each month. All fees are in Canadian Dollars (CAD). Accepted payment methods include pre-authorized debit, cheque, or electronic transfer. Late payments may incur administrative charges as specified in the agreement.

Fee Adjustments

The Residence reserves the right to adjust monthly fees with ninety (90) days written notice. Fee increases typically reflect increased operating costs, enhanced services, or changes in care requirements. Current residents will be notified of any fee changes in writing.

Additional Charges

Services not included in the base monthly fee will be billed separately. These may include transportation to appointments, specialized therapies, or personal shopping services. Additional charges will be itemized on monthly statements.

Termination and Move-Out

Notice Requirements

Either party may terminate the residence agreement with thirty (30) days written notice. Notice must be provided by the first day of the month. The Resident or Representative is responsible for monthly fees during the notice period regardless of actual occupancy.

Immediate Termination

The Residence may terminate the agreement immediately if: the Resident's behavior poses a safety risk to themselves, other residents, or staff; care needs exceed our capability to provide appropriate support; or there is non-payment of fees for thirty (30) days despite written notice.

Move-Out Procedures

Upon move-out, all personal belongings must be removed from the suite within seven (7) days. The suite will be inspected for damage beyond normal wear. Any necessary repairs will be charged to the departing resident's account. Refunds of prepaid fees will be calculated on a prorated basis.

Liability and Disclaimers

Limitations of Liability

Harbour Haven provides services with reasonable care and diligence. However, we cannot be held liable for outcomes related to pre-existing health conditions, natural aging processes, or medical events beyond our control. We are not responsible for the actions of healthcare providers engaged independently by residents or families.

Personal Property

While the Residence maintains security measures, we are not responsible for loss, theft, or damage to personal property kept in resident suites or common areas. We recommend that valuable items be insured separately. Residents may bring reasonable amounts of personal property subject to space and safety constraints.

Assumption of Risk

By residing at Harbour Haven, residents and their representatives acknowledge that certain risks inherent to senior living cannot be entirely eliminated. These include falls, medical emergencies, and interactions with other residents. We implement reasonable safety measures but cannot provide constant one-on-one supervision.

Privacy and Confidentiality

The Residence adheres to Ontario's Personal Health Information Protection Act (PHIPA) and maintains strict confidentiality of resident information. For details on how personal information is collected, used, and protected, please refer to our Privacy Policy.

Dispute Resolution

If concerns arise regarding services or care, we encourage resolution through direct communication with our management team. A formal complaints process is available and outlined in resident handbooks.

If disputes cannot be resolved internally, both parties agree to attempt mediation before pursuing legal action. Mediation will be conducted in Burlington, Ontario, by a mutually agreed mediator. If mediation is unsuccessful, disputes will be resolved through the courts of Ontario under the laws of the Province of Ontario and Canada.

Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings shall be conducted in the courts of Ontario.

General Provisions

Entire Agreement

These Terms and Conditions, together with the residence agreement and care plan, constitute the entire understanding between the parties. Any modifications must be made in writing and signed by both parties.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

These Terms may not be assigned by the Resident without written consent from the Residence. The Residence may assign these Terms in connection with a sale or transfer of the business.
